This English version is provided for informational purposes only. In case of discrepancy, the Spanish version shall prevail.

1. Purpose and Acceptance

1.1. This document governs access to and use of the website https://www.archivocanarias.com (hereinafter, the “Site” or “Website”), owned by Mariano Damián García Cruz – Archivo Canarias (hereinafter, the “Owner”).

1.2. Accessing, browsing or using the Site implies full and unconditional acceptance by the user (hereinafter, the “User”) of all of these Terms and Conditions of Use (hereinafter, the “Terms”).

1.3. If the User does not accept these Terms, they must refrain from using the Site.

2. Identification of the Owner

3. Nature of the Service

3.1. The Site constitutes a digital archive of Canary Islands cultural talent, freely accessible and publicly available, which publishes cultural profiles of individuals and collectives (artists, researchers, etc.) based on content provided by their respective owners.

Archivo Canarias is not an agency or a commercial intermediation platform and does not guarantee outcomes in collaborations or connections between participants. Its purpose is purely cultural and documentary, focused on building an archive of profiles. The Owner undertakes to maintain a truthful, updated, and high-quality resource, based on information provided by participants themselves.

3.2. The Site does not require user registration nor does it offer private areas, account creation, or subscription services. Participation in the project is carried out through an external online form, accessible via an independent link unconnected to the public website. This link is provided individually to people interested in participating, upon request or invitation from the Owner. Participation in the project is restricted to individuals over 18 years of age.

3.3. The Site is limited to the dissemination of cultural information and the visibility of artistic talent from the Canary Islands, without commercial intent. However, the platform may facilitate contact between professionals, entities, or companies in the cultural sector, without implying any commercial intermediation or financial gain by the Owner.

4. Definitions

User: Any person accessing and browsing the Site.

Participant/Collaborator: An individual or collective contributing content (texts, images, videos) through the designated form.

5. Conditions of Access and Use

c) The introduction of malware, code, or devices that may affect the Site.

d) Any action that infringes intellectual property, image, honour, or privacy rights of third parties.

5.3. The Owner reserves the right to suspend or interrupt access to the Site, in whole or in part, for technical or operational reasons.

6. Intellectual and Industrial Property

6.1. The design of the Site, its interface, navigation structure, compilation, and database (including its classification and tagging system) are the property of the Owner or third-party licensors and may be protected by copyright and/or database rights.

6.2. Images and videos are hosted on servers managed by the Owner or specialised providers (Digital Ocean, Dinahosting, or CDN networks) to optimise loading performance. The Owner remains responsible for all hosted content.

6.3. Extraction and/or reuse of all or substantial parts of the Site’s content or database is expressly prohibited without the Owner’s authorisation.

6.4. Trademarks, logos, and distinctive signs appearing on the Site are the property of the Owner or third parties and may not be used without prior authorisation.

7.4. Participants retain ownership of their copyrights and may request modification or removal of their Contributions. The Owner will process such requests within a reasonable timeframe, without prejudice to backup copies or legal obligations.

Archivo Canarias is a curated archive. Inclusion of profiles is not automatic, and the Owner reserves the right to accept or reject submissions without obligation to justify decisions.

7.5. Biographies and texts submitted by Participants may be adapted, summarised, or translated, where appropriate with the support of artificial intelligence tools, always under human supervision and without altering their essential meaning. This does not affect authorship or image rights.

8. External Links and Sharing Features

8.1. The Site may include links to third-party websites or content (e.g., Spotify, Instagram, YouTube profiles) and sharing buttons (email, social media).

8.2. These services are provided by third parties independent of the Owner. Access to them is governed by their own terms and policies; the Owner has no control or responsibility over their content, availability, security, or data processing.
